1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Pixel-Perfects ("Company," "we," "us," or "our") concerning your access to and use of our e-commerce store builder platform and services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

2. Services Description

Pixel-Perfects provides an affordable, multilingual e-commerce store builder platform that enables users to create, manage, and operate online stores. Our services include:

Store builder and customization tools
Payment processing integration
Analytics and reporting features
Email integration
Multilingual support
Hosting and infrastructure

3. Account Registration and Eligibility

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services. By using our services, you represent and warrant that you meet these requirements.

3.2 Account Creation

To use our services, you must create an account by providing accurate, complete, and current information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Ensuring your account information remains accurate and up-to-date

4. Pricing and Payment Terms

4.1 Beta Period

During the beta period, our services are provided free of charge. We reserve the right to end the beta period at any time with reasonable notice.

4.2 Subscription Pricing

After the beta period, our All-Inclusive Plan will be available at ₹499 per month, which includes:

Full access to all platform features
Unlimited products and pages
Payment processing integration
Analytics and email integration
Multilingual support

4.3 Transaction Fees

After your store processes ₹1,00,000 in total orders, a transaction fee of 1-1.2% will be applied to each subsequent order. This fee covers payment processing and platform maintenance costs.

4.4 Payment Terms

Subscription fees are billed monthly in advance
All fees are non-refundable unless otherwise stated
We reserve the right to change pricing with 30 days' notice
Failure to pay may result in service suspension or termination

5. User Responsibilities and Conduct

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree NOT to:

Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Sell illegal, counterfeit, or prohibited products
Engage in fraudulent or deceptive practices
Upload malicious code or attempt to breach security
Interfere with or disrupt the platform's operation
Use the service to spam or harass others
Resell or redistribute our services without permission

6. Intellectual Property Rights

6.1 Our Intellectual Property

The platform, including all content, features, functionality, software, and design, is owned by Pixel-Perfects and is protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain all rights to the content you upload to your store. By using our services, you grant us a limited license to host, store, and display your content as necessary to provide our services.

7. Service Availability and Modifications

We strive to provide reliable service but cannot guarantee uninterrupted access. We reserve the right to:

Modify, suspend, or discontinue any aspect of the service
Perform maintenance and updates
Change features or functionality
Impose limits on certain features

We will provide reasonable notice of significant changes when possible.

8. Termination

8.1 Termination by You

You may terminate your account at any time by contacting us or using the account settings. Upon termination, you will lose access to your store and data.

8.2 Termination by Us

We may suspend or terminate your account if you:

Violate these Terms
Fail to pay applicable fees
Engage in fraudulent or illegal activities
Pose a security risk to our platform

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.

9.2 Limitation of Liability

To the maximum extent permitted by law, Pixel-Perfects shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

10. Indemnification

You agree to indemnify and hold harmless Pixel-Perfects and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the service, violation of these Terms, or infringement of any rights of another party.

11. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through:

Good faith negotiations between the parties
Mediation if negotiations fail
Binding arbitration as a final resort

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the platform. Your continued use of the service after changes constitutes acceptance of the modified Terms.

14. Severability
